The John Sr. referenced is the John who recieved Edgecombe County NC Granville Land Grant. Edgecombe Co., NC Deed Book 1-155 : Earl Granville grant to John Stokes of Edgecombe Co, Oct 15, 1761 .... a tract of 382 acres on the Little Swamp. Witness: Samuel Swann, John Linton.


An Edgecombe County, North Carolina deed record, found in Deed Book 10, page 69 dated 28 Mar 1801 identifies John (Jr.) and William as John Sr's sons.

Edge. Co. Db 10, page 69, deed date 28 Mar 1801, recorded May Ct 1801, Amos Johnston, Edge. Co to William Philips, county aforesaid for $350 silver, a tract on the east side of Johnstons Mill Swamp beginning at a water oak in the said swamp at said Philips upper corner then along said Philips' line south to Dempsey Stokes' line to a corner pine in said line then west along said Stokes' line to a corner pine in said line being the corner of the land took up by James Scarborough then north along the line of the land took up by the said Scarborough to the (old division) line of the land that John Stokes Sr gave to his sons John & William Stokes being the corner between the land said Johnston bought of Joseph Ruffin and the land he bought of Samuel Ruffin, Sr then along the said old division line near by a north course to the head of the bog branch then down the said branch to the said Mill Swamp then down the mill swamp to the first station, including the land said Johnston bought of Samuel Ruffin, Sr and James Scarborough, containing 219 acres, signed Amos Johnston, wit Josiah A. Watson ("A" could be Mark), Martin Stokes. Abstracted 17 Feb 07, NCA film C.037.40009, CTC

Herbert is not named in John Jr.'s will of 1783:

Will of John Stokes dated May 8, 1783; Feb Ct. 1784: leaving beneficiaries of his estate: his wife, Elizabeth; and his children: William, Shadrick, David, Dempsey, Marcus; daughter: Betty Toler, and grandson William Johnson. Wit. Peter Cartwright, Thos. N. Cartwright, Hezeiah Cartwright.

Herbert is certainly tied to the John Sr. branch, but my current thinking is he is either the child of William or Dempsey. Herbert is first found in the 1810 Northampton NC census along with one of John Jr.'s children, Dempsey. Herbert next appears in the 1820 Darlington SC census. There are two Dempsey's in the 1820 census, one in Edgecombe, NC and one in Sumter SC. The Sumter SC Dempsey later appears in Twiggs County, GA along with a Samuel D. Stokes. The ages of both would support Samuel D. being the age of a son to Dempsey.
